All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork and computer code (collectively, “Content”), including but not limited to the design, structure, selection, coordination, expression and arrangement of such content, contained on the site is owned, controlled or licensed by or to LES ETTES COSMETICS GMBH, and is protected by trade dress, copyright, patent and trademark laws, and various other intellectual property rights and unfair competition laws.
Except as expressly provided in these Terms of Use, no part of the site and no content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including “mirroring”) to any other computer, server, Web site or other medium for publication or distribution or for any commercial enterprise, without LES ETTES COSMETICS GMBH’s express prior written consent.

Scope
Any offers, performances and delivery of our enterprise (in the following referred to as “we” or “LES ETTES COSMETICS
GmbH“) are made exclusively under these General Terms and Conditions. Any conflicting or deviating terms presented by the other party (in the following referred to as “buyer”) only take effect if we accept them in written form (fax is sufficient). Anyacts of performance from our side shall not imply our agreement to other terms than those mentioned
in the following. The General Terms and Conditions are also valid as a framework contract for all other business transactions between us and the buyer.

Contract Formation
Any order made by the buyer is valid and binding even without an express agreement of the LES ETTES COSMETICS
GmbH. We reserve the right to reject or partly reject the order as well as the right to partial delivery.

Shipping & Delivery
Orders are processed the same or next business day (Monday through Friday 11am-7pm, not including holidays), pending credit card authorization and verification.
Packages typically arrive within 2-5 days from the date we receive the order. Products will shipped directly from France by Post France. We are not bound by periods and dates of delivery unless we confirm them in writing. The same counts for transactions for delivery by a fixed date.

IMPORTANT - If a package is returned to France because the buyer did not claim the package, LES ETTES COSMETICS GmbH does not send replacements.
LES ETTES COSMETICS GMBH is not responsible for any actions taken by customs on your package during delivery.
LES ETTES COSMETICS GMBH has no control over this. Buyer is responsible for any customs charges that may be applied to your package. Customs determines these charges, and LES ETTES COSMETICS GMBH has no way of knowing what these charges may be.

In cases of force majeur periods and dates of delivery expand automatically for a maximum of one month. The same counts in cases of unforeseen obstacles within the operation of LES ETTES COSMETICS GmbH, any ancillary suppliers, organizing or transport companies, such as operational breakdowns or interruptions, delays in the delivery of raw,ancillary and operating material, actions of administrative authorities, strikes or lockouts.
If delivery is not realized within a month after the date stated in our written confirmation of the order, the buyer can determine a period of another month within which delivery has to be made. If the buyer does not receive delivery or the written confirmation of the dispatch within this month, he has the right to withdraw from the contract. Withdrawal needs to bein writing. Any delivery made before the receipt of the declaration of withdrawal is considered in due
course. If the buyer is in default with any obligation he owes under his business relationship with us, LES ETTES COSMETICS GmbH is only bound to deliver upon advance payment or upon a security provided for the price and for the other open obligations.

Prices
Unless otherwise agreed upon in writing, all prices stated by the LES ETTES COSMETICS GmbH are to be understood in EURO exclusive of Value Added Tax and always regard 1 unit. The price is determined by the relevant pricelist valid on the day of delivery. The LES ETTES COSMETICS GmbH may raise or reduce the prices in the following cases: change of wage costs due to collective agreements in the business sector, internal accounts or other changes General Terms and Conditions of LES ETTES COSMETICS GMBH regarding relevant costs for calculation and delivery (such as costs of raw materials, energy,transport, ancillary deliveries, financing etc.).

Return & Exchange Policy
Returns can be made only if the products are in unopened condition. Acceptable reasons for an return: factory defects, wrong item was sent, or error on our part. Customers must send us an e-mail stating their name and invoice number within 5 days of receiving the product if they are requesting a return. We will email you instructions on how to return the product.

Bad performance, duty to examine & complain
In cases of bad performance the LES ETTES COSMETICS GmbH can choose freely to perform one of the following remedies: repair, replacement, cancellation of contract or reduction of price. Warranties regarding special characteristics of our products as to their quality or fitness for a certain usage need our written confirmation to be binding.

The buyer shall be obliged to examine the goods immediately after delivery regarding quality and quantity according to Art 377 of the Austrian Commercial Code (§ 377 UGB). If a defect is detected, it has to be reported to the Les Ettes Cosmetics GmbH in writing stating the type and seriousness of the defect. The report has to be effected immediately, at the latest within 3 working days after detection. In the absence of a complaint the goods are assumed to be approved of.

Changes of the product which are not approved of by us, deprive the buyer of any rights following from bad performance. We expressly exclude any liability for used goods.

Accounts, Passwords and Security
Personal information is gathered by lesettes.com during the order check out process.  During the check out process, your name, address, e-mail address, telephone number, fax number and credit card information are collected.
For security reasons, lesettes.com does not store sensitive credit card information on our servers.

The security of the information regarding your order is very important to us. We use the 128-bit Secure Socket Layer protocol to protect the security of your online order information. You can be assured that all sensitive information will be handled with discretion.  SSL technology encrypts your order information to protect it from being decoded by anyone other than lesettes.com.
Once you enter the checkout page your computer will begin communicating with our server in secure mode. You can tell that you are in secure mode by the following:
-The “http” in the web address will be replaced by “https”.
-Depending on the browser, you will see either a padlock (Microsoft Internet Explorer, AOL, Netscape Communicator) or a solid key (Netscape Navigator) in the lower section for the browser window.

Privacy
LES ETTES COSMETICS GMBH’s Privacy Policy applies to use of this Site, and its terms are made a part of these Terms of Use by this reference. Additionally, by using the Site, you acknowledge and agree that Internet transmissions are never completely private or secure. You understand that any message or information you send to the Site may be read or intercepted by others, even if there is a special notice that a particular transmission (for example, credit card information) is encrypted.

Copyright
Copyrights and other protectable rights regarding the products delivered by us as well as the products, samples or pictures provided by us have to be respected. The buyer expresslyagrees to abstain from making copies and agrees to support the LES ETTES COSMETICS GmbH in protecting its intellectual property rights. All products and the manufacturing of the products as well as samples, catalogues, leaflets, pictures etc are the intellectual property of LES ETTES COSMETICS GmbH. The buyer has no rights of use or exploitation.

The buyer is not entitled to transfer the goods delivered by us to other countries, not even in the line with his internal business. It is also expressly forbidden to re-export the products received from us to countries other than European member states. In the case of an infringement of this provision the Les Ettes Cosmetics GmbH is entitled to claim a penalty whose amount is to be determined by us. The penalty is due within 14 days.
